1. Agreement
These terms are an agreement between you and XPNSR ("we", "us") for the use of XPNSR Tracker and related services (the "Service"). By creating an account or using the Service you accept them on behalf of yourself or the business you represent, and confirm you are at least 18 and authorised to do so.
2. The Service
XPNSR Tracker is a hosted tool for tracking ad clicks and conversions, routing traffic, filtering invalid traffic and reporting on campaigns. Features available to you depend on your plan. We improve the Service continuously and may change features, as long as we do not materially reduce the core functionality of a plan you have paid for during the paid period.
The Enterprise self-hosted edition is provided under a separate licence agreement, which takes precedence over these terms where they differ.
3. Your account
- Provide accurate information and keep your credentials confidential.
- You are responsible for activity under your account and for the people you invite to your workspace.
- Tell us promptly at support@xpnsr.tech if you suspect unauthorised access.
4. Plans, trials and payment
- Plans are billed in advance through Stripe for the period you choose: monthly, 6 months or 12 months. Prepaid periods carry the discount shown at checkout.
- Start and Pro include a 7-day trial. If you do not cancel before it ends, the plan starts and your card is charged.
- Subscriptions renew automatically for the same period until cancelled. You can cancel at any time in the Billing page; access continues until the end of the paid period.
- Payments are non-refundable except where required by law.
- We may change prices with at least 30 days' notice; changes apply from your next renewal.
- If a payment fails, we may limit the account until it is settled.
5. Acceptable use
You must not use the Service to:
- break any law, or promote illegal products or services;
- distribute malware, phishing or deceptive downloads, or host content that infringes others' rights;
- send spam or traffic you are not entitled to send;
- attack, overload, probe or reverse-engineer the Service, or get around plan limits or access controls.
You are responsible for your campaigns, landing pages and offers, and for complying with the laws and the policies of the advertising platforms and networks you use. We may suspend content or accounts that break this section.
6. Your data
You own the data you put into the Service and the data it records for you. You give us permission to process it only to provide and support the Service. Our Privacy Policy describes how we handle personal data; for data about your visitors, we act as your processor. You can export your data at any time while your account is active.
7. Our rights
The Service, its software and its design belong to us and our licensors. These terms give you a right to use the Service during your subscription; they do not transfer any ownership.
8. Availability and support
We work to keep the Service available and fast, but do not guarantee it will be uninterrupted or error free. Support is available by email and in the account; some plans include priority support.
9. Suspension and termination
You may close your account at any time. We may suspend or end access if you materially breach these terms, fail to pay, or if required by law; where reasonable we will give notice first. After termination your data is deleted as described in the Privacy Policy.
10. Disclaimer
To the extent permitted by law, the Service is provided "as is", without warranties of any kind, including fitness for a particular purpose. Tracking, attribution and fraud detection are estimates and may not be complete.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability under these terms is limited to the fees you paid us in the 3 months before the event giving rise to the claim.
12. Governing law
These terms are governed by the laws of the United States. Disputes will be resolved by the competent courts of the United States.
13. Changes
We may update these terms. We will post the new version here and notify account owners of material changes by email at least 14 days before they apply. Continuing to use the Service after that means you accept them.
